Terms and Conditions

1. Introduction

Welcome to Pachamama.

We are a Mauritian small scale farm engaged in the cultivation of vegetables and the processing of agricultural products into consumable food products. These Terms and Conditions govern all business relationships, sales, deliveries and use of our services.

By purchasing our products or engaging with our business, you agree to these Terms and Conditions.

2. Our Products

We produce and supply:

  • Fresh vegetables and herbs;
  • Processed vegetable products;
  • Food products derived from agricultural produce;
  • Other agricultural products as may be available from time to time.

All products are subject to availability and seasonal conditions.

3. Product Availability

Agricultural production is dependent on weather conditions, harvesting schedules, pests, diseases and other factors beyond our control.

We reserve the right to:

  • Modify product availability;
  • Limit quantities supplied;
  • Discontinue products without prior notice;
  • Allocate products according to available supply.

4. Pricing

Prices are quoted in Mauritian Rupees (MUR).

Prices may be revised periodically due to changes in production costs, transportation costs, market conditions or regulatory requirements.

Any quotation provided remains valid only for the period specified in the quotation.

5. Orders

Orders may be placed by telephone, email, written purchase order or any other approved method.

An order is considered accepted only when confirmed by the Company.

We reserve the right to refuse any order at our discretion.

6. Payment Terms

Unless otherwise agreed in writing:

  • Payment is due upon delivery or collection.
  • Wholesale customers may be granted credit terms subject to separate agreement.
  • Late payments may result in suspension of future deliveries.

The Company reserves the right to charge interest on overdue amounts where permitted by law.

7. Delivery and Collection

Where delivery services are provided:

  • Delivery dates are estimates only.
  • Delays caused by weather, traffic, equipment failure or other circumstances beyond our control shall not constitute a breach of these Terms.
  • Customers must ensure that an authorized person is available to receive deliveries.

Risk in the products passes to the customer upon delivery or collection.

8. Inspection of Products

Customers are responsible for inspecting products upon receipt.

Any claim regarding:

  • Damaged products;
  • Missing items;
  • Incorrect deliveries; or
  • Quality concerns

must be reported within 24 hours of receipt.

Failure to notify us within this period may constitute acceptance of the products.

9. Product Quality

We take reasonable measures to ensure compliance with applicable food safety and agricultural standards in Mauritius.

Due to the natural nature of agricultural produce, variations in:

  • Colour;
  • Size;
  • Shape;
  • Weight; and
  • Appearance

shall not be considered defects.

10. Food Safety and Allergens

Processed products should be stored and consumed according to the instructions provided.

Customers are responsible for checking ingredient and allergen information before consumption.

The Company shall not be liable for reactions resulting from undisclosed allergies or improper handling after purchase.

11. Intellectual Property

All logos, trademarks, photographs, product names, labels, promotional materials and website content remain the property of the Company unless otherwise stated.

No reproduction or commercial use is permitted without prior written authorization.

12. Limitation of Liability

To the maximum extent permitted under Mauritian law, the Company shall not be liable for:

  • Indirect or consequential losses;
  • Loss of profits;
  • Business interruption;
  • Delays caused by circumstances beyond our reasonable control.

Our liability for any claim relating to our products shall not exceed the purchase price paid for the affected product.

13. Force Majeure

The Company shall not be responsible for failure to perform its obligations due to events beyond its reasonable control, including:

  • Cyclones;
  • Floods;
  • Drought;
  • Fire;
  • Disease outbreaks;
  • Government restrictions;
  • Labour disputes;
  • Transportation disruptions;
  • Acts of God.

14. Privacy

Personal information collected from customers and suppliers shall be handled in accordance with our Privacy Policy and applicable Mauritian data protection laws.

15. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of Mauritius.

Any dispute arising from these Terms shall be submitted to the competent courts of Mauritius.
